BoughtWell membership terms
1. Who we are and what BoughtWell is
1.1 BoughtWell is operated by Estallion Investments Limited, a company registered in England and Wales under number 08760284, whose registered office is at 113 Romford Road, London E15 4LY, VAT number GB484294850 ("we", "us"). You can contact us at support@boughtwell.co.uk.
1.2 BoughtWell is a private, paid membership for people who invest in UK residential property. Anyone aged 18 or over can join. Membership is currently capped at 500 seats and 30 Desks, and we may raise the cap (2.2).
1.3 BoughtWell gives members information about properties for sale: a short list of deals, the evidence behind each one, the BoughtWell Score and estimate, and the members' valuation. Members can value deals, post deals, find partners for a deal and request quotes from service partners.
1.4 We are not an estate agent and we do not act for buyers or sellers in any sale. We are not authorised by the Financial Conduct Authority. We do not give investment, financial, tax, legal or surveying advice, we do not arrange or manage investments, and we never hold money for members.
1.5 These terms, together with the house rules (section 4) and our privacy notice, form the agreement between you and us. If you join as a consumer, you have the legal rights described in section 3 and nothing in these terms reduces them.
2. Joining
2.1 Joining. Anyone aged 18 or over can join BoughtWell. There is no application or approval: you sign up, choose a plan and start your 14-day free trial (3.4A). The questions we ask when you sign up help us show you the right deals; we do not use them to vet you.
2.2 Waitlist. Membership is currently capped at 500 seats, including Desk seats. We may raise or remove the cap at any time; it is not a promise to members that numbers will stay at 500. When every seat is taken, you join a waitlist in date order, with referrals first. When a seat opens, we hold it for you for 7 days.
2.3 Removing an account. We may remove an account that gives false information, is used for fraud or to distort members' valuations, or breaks the house rules (section 4), as set out in 4.2. If you are still in your free trial, you are never charged.
2.4 Guest passes. We may offer guest passes from time to time. When we do, the terms shown with the pass apply.
2.5 Your account. Your membership is personal. You must not share your sign-in or let anyone else use your account. Desk seats are for named individuals at the firm that holds the Desk.
2.6 Eligibility. You must be 18 or over and resident in the United Kingdom, or investing in UK property through a UK entity.
3. Plans, fees, renewal and cancelling
3.1 Plans and prices. All prices include VAT at the current rate.
| Plan | Yearly | Monthly | Notes |
|---|---|---|---|
| Member | £390 | £49 | |
| Member Pro | £990 | £119 | Everything in Member, plus Pro features |
| Desk | £3,500 for 3 seats | Not offered | Extra seats £990 a year each; Desk seats count towards the member cap |
| Founding member | £290 for the first year | Not offered | First 100 Members only, Member plan, then £390 a year |
3.2 Payment. You pay by card through our payment provider, Stripe, at the start of each term. We send an invoice showing VAT.
3.3 Renewal. Your membership renews automatically at the end of each term at the price then shown on our pricing page. We remind you at least 14 days before a yearly renewal, with the date, the price and how to cancel. If a price is going up, we tell you at least 30 days before the renewal it applies to. On a monthly plan, we also send you a reminder at least every 6 months saying what you pay and how to cancel.
3.4 Cancelling at any time. You can cancel from your account settings in a few steps, with no need to contact us. Your access continues to the end of the term you have paid for. We do not refund part-used terms, except as set out in 3.5 and 3.7.
3.4A Free trial. Member and Member Pro start with a 14-day free trial; Desks do not. We take your card details at the start but charge nothing during the trial. We email you at least 3 days before it ends with the date, the amount, how often you will be charged and how to cancel. If you cancel before the trial ends, you pay nothing. If you do not, your membership starts on day 15 and the first payment is taken. One free trial per person and per card. During the trial you can use BoughtWell fully, except posting deals and Partner up introductions.
3.5 Your 14-day right to cancel (consumers). If you join as a consumer, you have a legal right to cancel within 14 days under regulations 29 to 31 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (SI 2013/3134). Because BoughtWell starts straight away, you ask us to begin the service immediately when you sign up (regulation 36). Your free trial falls within this 14-day period, so cancelling during the trial costs nothing. If you cancel within the period after paying, we refund what you paid less a proportionate amount for the days you were a paying member (regulation 34). You also have any further cancellation right the law gives you after a free trial ends or when a membership renews. Apart from these, renewals are not refundable.
3.6 Failed payments. If a payment fails, we tell you and try again over 7 days, and you keep access in the meantime. If it still fails, your membership lapses. You can rejoin at any time, subject to a seat being free.
3.7 If we end or change the service. If we close BoughtWell or permanently remove a main feature of your plan, we refund the unused part of your term. Changes during our founding phase (3.10) and data that stops being available from its source (5.8) are not a removal of a main feature.
3.8 Desks. The Desk owner pays for and manages the seats. Adding a seat is charged for the rest of the current term. Removing a seat takes effect at renewal. Desk members are businesses, so section 3.5 does not apply to Desks.
3.9 No other charges. There are no credits, usage limits or one-off charges. We do not take a share of any member's deal.
3.10 Our founding phase. BoughtWell is new and in its founding phase. We are testing, improving and changing features all the time, and some updates may briefly affect the service: a feature may change, move, pause or be unavailable while we work on it. This is part of being a founding member or a member at this stage. We do not give refunds or credits for this kind of disruption. Your rights in 3.7 still apply if we close BoughtWell or permanently remove a main feature of your plan, and if the core service (deals, scores and members' valuations) is unavailable for more than 14 days in a row, we will extend your membership by the time it was down.
4. House rules and moderation
BoughtWell works because members keep to these rules. You agree to them when you join.
- Value deals honestly. Give the price you genuinely believe a deal is worth. Do not coordinate valuations with other members, and do not talk a deal down so that you or someone you know can buy it more cheaply.
- What is shared here stays here. Do not copy, forward, publish or sell deals, memos, valuations, member records or discussions outside BoughtWell.
- Declare an interest. If you post a deal or comment on one that you, your family, your firm or a client is connected to, say so on the post.
- Disagree about deals, never about people. No abuse, harassment, discrimination or spam.
- No investment offers. Do not use BoughtWell to ask members to put money in with you for a fixed or promised return, or to promote any investment scheme (see section 7).
- Be who you say you are. Use your real name and accurate details.
4.1 Moderation. BoughtWell is moderated. Our team reviews reports from members and unusual patterns in valuations, and automatically flags messages that ask for money, bank details or promise returns.
4.2 What we may do. If we reasonably believe you have broken these rules, we may remove content, exclude a valuation from the members' figure, restrict features, suspend your account while we look into it, or end your membership. We tell you which rule and give you a chance to respond, unless the matter is serious or unlawful.
4.3 Refunds after a breach. If we end your membership for a serious or repeated breach, we do not refund the rest of your term.
4.4 Reporting and appeals. You can report any post, message, member or deal room using the report button, or by emailing support@boughtwell.co.uk. If we remove your content or restrict your account, you can ask us to look again by replying to our email; a different person on our team will review it and tell you the outcome.
5. Information on BoughtWell is not advice
5.1 The BoughtWell Score, the BoughtWell estimate, the members' valuation, the Rare find mark, refurb and repair ranges, rent and yield figures, development potential, Maximum Bid and every other figure are information to help you decide. We make no recommendations. They are not advice, not a recommendation to buy, and not a valuation for lending, insurance or any legal purpose.
5.2 Figures come from public and licensed data (including HM Land Registry, EPC, planning and Environment Agency data), listing information and our own models. Each shows its source and how sure we are. Data can be wrong, incomplete or out of date, and a model can be wrong. Our published accuracy figures show how our estimates have performed.
5.3 Before you offer on or buy any property, get your own independent advice, including a survey, legal advice from a conveyancer and, where relevant, mortgage and tax advice.
5.4 The members' valuation reflects what members said they would pay. Members are not advisers and may be wrong.
5.5 Illustrations on our website, such as what one good find can be worth, use sample deals. They are not a promise or a forecast of returns. Most deals are ordinary.
5.6 We do not guarantee that any deal will be available, that a seller will accept an offer, or that a permission, plot or opportunity shown on BoughtWell can be used.
5.7 Planning, side plot, roof, extension and permission insights are indicative. We show how confident we are in each one, and we never take ownership of a planning judgement. Check with the council and your own advisers before relying on any of them.
5.8 Where our data comes from. Much of what we show comes from third-party sources, including government and public bodies (such as HM Land Registry, EPC, planning and Environment Agency records), property listings and licensed data. We do not control these sources. If a source changes, limits access, starts charging or stops publishing, we may no longer be able to show that information, or show it in the same way. We will tell you when this affects a feature, but we do not give refunds or credits for it.
5.9 Your decisions are your own. Any offer, purchase, partnership or other deal you make is your decision alone. We accept no responsibility for any deal you do, or do not do, using information found on BoughtWell, from us or from other members.
6. Your content and confidentiality
6.1 Your content. You own what you post: deals, comments, notes, documents and your valuations. You give us a non-exclusive, royalty-free licence to store, show and use it within BoughtWell to run the service, including combining valuations into the members' valuation and checking calls against sold prices for your record.
6.2 What you post. You must have the right to post anything you share. Do not post listing photos or descriptions copied from property portals, anyone's personal data without a lawful reason, or anything unlawful or confidential to someone else.
6.3 Confidentiality. Deals, memos, valuations, member records and discussions on BoughtWell are confidential to members. You may use them for your own investment decisions and share them with your own professional advisers, but not publish, forward, resell or copy them in bulk, including by scraping or automated tools.
6.4 Our material. BoughtWell's scores, estimates, models, software and design belong to us or our licensors. Data from HM Land Registry and other public sources is used under their licences, which we credit on the site.
6.5 Your record. Your valuations build your track record. Members see your record according to the settings you choose; your individual valuations are never shown to other members by name.
7. Partner up and deal rooms
7.1 What Partner up is. Partner up lets members who would buy the same property find each other, so that two to four members can buy it together, each taking an active part. It is an introduction service only.
7.2 What we do and do not do. We check every introduction before names or contact details are shared, and we provide a private deal room with shared notes, numbers, a checklist and a heads of terms template. We do not:
- give investment, legal, tax or financial advice, or vet any member's finances, competence or character beyond the checks described here;
- hold, receive or transfer money for members;
- set up, run or own any company, partnership or arrangement that members use to buy;
- draft or negotiate the binding agreement between members;
- take any share, fee or commission from any deal members make together.
7.3 Active partners only. Every member in a deal room must have a real, active role in the purchase. Partner up must not be used to raise money from people who will not take part in running the investment, or to offer anyone a fixed or promised return. This keeps member partnerships outside the definition of a collective investment scheme in section 235 of the Financial Services and Markets Act 2000, and avoids financial promotions restricted by section 21 of that Act. We will remove any post or room that breaks this rule.
7.4 Your own agreement. Any partnership is agreed directly between the members involved, through their own solicitors. The heads of terms template is a starting point for those solicitors, not a contract. You are responsible for your own due diligence on the property and on your partners.
7.5 Our checks. Our team reviews each accepted introduction, usually within four working hours on weekdays. We may approve, ask a question, or decline without giving the internal reason. Approval means only that the introduction passed our checks; it is not an endorsement of any member or deal.
7.6 Leaving and closing. Any member can leave a deal room. A room closes after 30 days with no activity, or when the property is sold to someone else. Notes stay visible only to people who were in the room.
7.7 Reviews. After a completed purchase, partners may leave each other a private review. Other members see only a combined score, once a member has three or more reviews.
8. Partner services
8.1 When a deal calls for it, BoughtWell may suggest services such as surveys, conveyancing, mortgage or bridging brokers, refurb quotes, joint venture solicitors and accountants. We show at most three, with the reason each is shown.
8.2 We pass your details to a partner only if you tick the box to agree, and we record when you did. Marketing from partners needs a separate tick. Both are unticked to start with.
8.3 Partners may pay us when you use them. This never affects a Score, an estimate, a ranking or which deals you see.
8.4 Partners are independent businesses. Your contract for their service is with them, not us. We are not responsible for their advice or work, but tell us if something goes wrong and we will review whether they stay on BoughtWell.
8.5 Mortgage and bridging introductions are made only to firms authorised by the Financial Conduct Authority, and we describe them only as introductions.
9. Identity, verification and your data
9.1 LinkedIn. If you sign in with LinkedIn, we receive your name, email address and profile photo, and mark your profile "LinkedIn linked" when your name matches your profile.
9.2 Optional ID verification. You may choose to verify your identity through Stripe Identity, using a passport or driving licence and a selfie. It is never required. If you verify, your profile shows an "ID verified" badge. We keep only the result, the date, the type of document and Stripe's reference; we never receive or keep the document images, document number or your date of birth. You can remove the badge and that record at any time in Settings. Stripe processes the check under its own privacy terms.
9.3 Your data. We are the controller of your personal data under the UK GDPR and the Data Protection Act 2018. Our privacy notice explains what we collect, why, our lawful bases, how long we keep it, who we share it with (including Stripe, our hosting providers and partners you choose) and your rights, including access, correction and erasure. We never sell your data.
9.4 Members' details. Details of other members you see on BoughtWell, especially in deal rooms, may be used only for the purpose they were shared.
10. Liability, ending membership, changes and disputes
10.1 Our service. We provide BoughtWell with reasonable care and skill, as required by section 49 of the Consumer Rights Act 2015 for consumer members. We do not promise it will be uninterrupted or error-free.
10.2 What we are not liable for. Because BoughtWell gives information and not advice (section 5), we are not liable for decisions you make, for any loss on a property purchase, or for the acts of other members or partners. We are not liable for loss that was not foreseeable, or for business losses such as lost profit or opportunity where you use BoughtWell for a business.
10.3 Limit. Our total liability to you in any year is limited to the fees you paid us in the 12 months before the claim, or £100, whichever is higher.
10.4 What we never exclude. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that cannot be limited by law, including under section 65 of the Consumer Rights Act 2015 (consumers) or the Unfair Contract Terms Act 1977 (businesses).
10.5 Ending your membership. You may cancel at any time (section 3). We may end your membership on 30 days' notice for any reason, refunding the unused part of your term, or straight away for a serious breach of these terms or the house rules (section 4).
10.6 Changes to these terms. We may update these terms. We tell you at least 30 days before a change that affects you materially. If you do not accept it, you may cancel before it takes effect and we refund the unused part of your term.
10.7 Complaints. Tell us at support@boughtwell.co.uk. We reply within 5 working days and aim to resolve complaints within 30 days. We do not currently use an alternative dispute resolution scheme; if we cannot resolve your complaint, you may take it to court.
10.8 Law. These terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
10.9 Notices. We contact you by email at the address on your account, and in the app. You can contact us at support@boughtwell.co.uk or by post to our registered office.
10.10 General. If a court finds part of these terms unenforceable, the rest still applies. We may transfer this agreement to another business that takes over BoughtWell, and we will tell you if we do; you may cancel if you are unhappy. You may not transfer your membership. No one else has rights under these terms (Contracts (Rights of Third Parties) Act 1999). If we do not enforce a term straight away, we can still enforce it later.
